Important. Please read this disclaimer carefully before purchasing or using Algetris. By accessing the Service you confirm that you have read, understood, and agree to this disclaimer in its entirety. This disclaimer forms part of, and should be read together with, the
Terms of Service, including in particular the indemnification provisions in Section 13 thereof.
1. Informational and Educational Purposes Only
Algetris is a technical analysis charting tool provided solely for informational and educational purposes. Nothing on the Algetris website, within the indicator, or in any associated documentation, communications, or Configuration Examples constitutes:
- Investment advice or financial advice of any kind;
- A recommendation, solicitation, or offer to buy, sell, or hold any financial instrument, security, commodity, or currency;
- A trading strategy, trading system, or managed trading service;
- Tax, legal, or accounting advice.
All analytical outputs, structural sequence visualisations, and parameter configurations provided by Algetris are impersonal — they are not tailored to your individual financial situation, investment objectives, risk tolerance, or experience level. You should not rely on the Service as a substitute for your own independent research and judgment.
2. Not a Regulated Financial Service
The Operator of Algetris is not registered as an investment adviser, financial analyst, broker, dealer, portfolio manager, or any other regulated financial entity under:
- Polish law (Ustawa z dnia 29 lipca 2005 r. o obrocie instrumentami finansowymi; Ustawa z dnia 27 maja 2004 r. o funduszach inwestycyjnych);
- European Union law, including MiFID II (Directive 2014/65/EU) and its implementing measures;
- Any other applicable national or international financial regulation.
Algetris is a technical analysis software tool — not a financial service. The provision of this tool does not constitute a regulated activity under MiFID II or under Polish financial law. If you require regulated investment advice, please consult a licensed financial professional.
3. Trading Risk Warning
Trading and investing in financial markets — including but not limited to equities, indices, futures, commodities, foreign exchange, and cryptocurrencies — involves substantial risk of loss and is not suitable for all individuals.
- You may lose some or all of your invested capital;
- Past performance of any market, instrument, or strategy does not guarantee future results;
- Leveraged products (futures, CFDs, options) can result in losses exceeding your initial deposit;
- Market conditions can change rapidly and without warning due to economic, political, regulatory, or other factors;
- No technical analysis tool — including Algetris — can predict future price movements with certainty.
You should carefully consider whether trading or investing is appropriate for you in light of your financial circumstances, experience, and risk appetite. The Operator strongly recommends that you seek independent financial advice before engaging in any trading activity.
4. Simulated and Hypothetical Performance Disclaimer
Critical disclosure. The Configuration Examples (calibrated parameter sets) included with Algetris subscriptions are derived entirely from historical data simulation. The results, statistics, and metrics associated with these configurations are hypothetical and simulated — they are NOT results from actual real-money trading.
Simulated and hypothetical performance results have inherent and material limitations:
- Hindsight bias: Simulations are constructed using historical data. The optimisation process may benefit from knowledge of past price behaviour that could not have been known at the time of the trade;
- No real execution: Simulated results do not account for actual order execution. In live markets, entries and exits may differ significantly from theoretical prices due to slippage, partial fills, requotes, or broker-specific execution conditions;
- No transaction costs: Unless explicitly stated, simulated results may not fully account for commissions, spreads, swap/rollover fees, or other trading costs that reduce actual profitability;
- No liquidity constraints: Historical simulations assume unlimited liquidity at the simulated price. In live markets, large orders or low-liquidity conditions may result in worse execution;
- Platform limitations: TradingView's backtesting engine has known limitations including bar-magnification effects and differences from live market data. Results reproduced on TradingView may differ from the Operator's external optimisation results;
- Psychological factors: Hypothetical performance results cannot simulate the emotional and psychological challenges of real trading, including the ability to follow a system during drawdown periods;
- Market regime changes: A configuration that performed well in historical simulation may not perform similarly in future market conditions. Markets evolve — structure that was consistent in the research window may not persist.
No representation is made, implied, or should be inferred that any subscriber's account will or is likely to achieve results similar to those shown in any historical simulation, calibration output, backtested result, or example provided by Algetris. Configuration Examples are provided as research starting points — not as predictions, expectations, or benchmarks for your actual trading results.
5. Data Source Disclosure
All historical analysis underlying Configuration Examples is based on OHLCV (Open, High, Low, Close, Volume) price data sourced from TradingView, representing aggregated exchange feed data on the M15 (15-minute) timeframe.
TradingView® is a registered trademark of TradingView, Inc. TradingView has no affiliation with and does not endorse the Algetris indicator or the Operator. The Operator is an independent third-party developer operating on the TradingView platform.
The Operator does not guarantee the accuracy, completeness, or timeliness of data provided by TradingView. TradingView data is provided "as is" and is subject to TradingView's own terms of service. Discrepancies between TradingView data and data from other providers may exist and may affect the consistency of simulated results when reproduced on different platforms or data feeds.
6. Configuration Examples — Classification
The calibrated parameter configurations included with Algetris subscriptions are historical research templates. They represent one possible starting point for your own analysis and adaptation — not a recommended approach, not a validated trading strategy, and not a guarantee of any specific outcome.
A Configuration Example is:
- A set of indicator parameters that produced structurally consistent results in historical data simulation across specified instruments and sessions;
- Validated on at least two separate calendar years to reduce single-period overfitting;
- Optimised using a quality-adjusted composite scoring formula, not maximum win rate;
- Updated quarterly based on new historical simulation runs over a rolling 12-month window.
A Configuration Example is NOT:
- A guarantee of profitability in live trading;
- A prediction that historical behaviour will repeat;
- A personalised recommendation for your trading;
- A substitute for your own research, testing, and judgment.
The list of instruments covered by Configuration Examples may change over time. The Operator makes no commitment to maintain coverage of any specific instrument indefinitely.
7. Limitation of Liability
To the maximum extent permitted by applicable law, the Operator shall not be liable for any financial losses, trading losses, lost profits, or any direct, indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of, or reliance on, the Algetris indicator or any Configuration Example;
- Any trading or investment decision made based on Algetris outputs;
- Any inaccuracy, incompleteness, or delay in the Algetris indicator's data or calculations;
- Any interruption, suspension, or discontinuation of the Service.
The Operator's total aggregate liability is further limited in accordance with the Terms of Service. In addition, by using the Service, you agree to indemnify and hold harmless the Operator from any claims arising from your trading decisions or use of the Service, as more fully set out in Section 13 of the Terms of Service.
Nothing in this disclaimer limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded under Polish or EU law.
8. Your Responsibility
All trading and investment decisions are solely your own responsibility. Before acting on any output from Algetris, you should:
- Independently verify and evaluate the analytical output;
- Consider your own financial situation, experience level, and risk tolerance;
- Apply your own risk management principles and position sizing discipline;
- Consider consulting a licensed financial adviser.
