Read carefully before subscribing. These Terms constitute a legally binding agreement between you and the operator of Algetris. By purchasing a subscription or accessing the Algetris indicator, you confirm that you have read, understood, and agree to these Terms in full. The processing of your personal data is governed by our Privacy Policy, which complies with Regulation (EU) 2016/679 (RODO/GDPR).

1. Definitions

The following terms have the meanings set out below whenever used in these Terms and any associated Algetris legal documents:

"Terms" — this Terms of Service agreement, including all documents incorporated by reference (Privacy Policy, Cookie Policy, Risk Disclaimer, Refund Policy);
"Service" or "Algetris indicator" — the Algetris Pine Script technical analysis indicator, Configuration Examples, and all related content and updates delivered via TradingView;
"Operator", "we", "us" — the independent individual developer operating Algetris, based in the Republic of Poland, EU;
"You", "User", "Subscriber" — any individual who accesses, uses, or subscribes to the Service;
"Configuration Examples" — parameter presets derived from historical market data simulation runs, delivered as TradingView preset settings and updated quarterly;
"Subscription" — the recurring monthly billing arrangement that grants access to the Service;
"TradingView" — the charting platform operated by TradingView, Inc., through which the Service is delivered;
"Whop" — Whop.com, the payment platform through which all subscription payments are processed.

2. Operator & Payment Processor

Algetris is operated by an independent individual developer based in the Republic of Poland, European Union ("Operator", "we", "us"). For contact, see Section 20.

All subscription payments, billing, tax collection, and payment disputes are handled through Whop.com, the payment platform used by the Operator. When you purchase a subscription, your payment is processed through Whop. Whop's own Terms of Service and Privacy Policy govern the payment transaction. The Operator does not have access to your payment card details.

The Operator reserves the right to refuse or withdraw access to the Service on reasonable grounds, including where the Operator has reasonable cause to believe that a user has violated any provision of these Terms, for reasons of platform security, fraud prevention, or compliance with applicable law.

3. Description of Service

Algetris is a technical analysis charting indicator for the TradingView platform, delivered via TradingView's Pine Script environment. The Service consists of access to the Algetris indicator and all its analytical features, Configuration Examples delivered as TradingView preset settings, quarterly updates to Configuration Examples, and access to new instrument configurations as they are published. A full description of current features is available on the Algetris website.

The Service is provided for informational and educational purposes only. It is a self-directed analytical tool. The Operator does not monitor your trading activity, does not have access to your brokerage account, and does not provide personalised investment advice of any kind. Algetris is not a financial instrument, investment product, trading signal service, or managed account service.

Indicator levels are not trading signals. The Algetris indicator displays structural reference levels including Entry, Stop Loss (SL), and Take Profit levels (TP1, TP2, TP3). These levels are analytical reference points derived from the indicator's structural sequence logic (Range, Sweep, Displacement). They are not buy or sell signals, not entry or exit instructions, and not trading recommendations of any kind. The display of any level on your chart does not constitute advice to open, close, or modify any trading position. All decisions about whether to act on any displayed level — and how — rest entirely with you.

4. Service Provided "As Is"

No warranties. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

The Operator does not warrant that:

The indicator will meet your specific trading objectives or requirements;
The indicator will operate without interruption, error, or delay;
Any Configuration Examples, analytical outputs, or structural reference levels will produce profitable trading results;
The indicator will be available continuously or at any specific time, including during TradingView platform outages or maintenance;
Any defects or errors in the indicator will be corrected within any particular timeframe;
Data, calculations, or outputs produced by the indicator will match those on other charting platforms, brokerage platforms, or data providers. Discrepancies may arise due to differences in data vendors, time-stamping, rounding, or contract specifications.

Your use of the Service is entirely at your own risk. You assume full responsibility for verifying any analytical output before acting on it.

5. Simulated Performance Disclaimer

Important — simulated results are not a guarantee of future performance. Configuration Examples and any backtesting results provided through the Service are based on historical data simulations. Such results have inherent limitations that you must understand before relying on them in any way.

Specifically:

Simulated results do not represent actual trading. Since trades have not actually been executed, results may under- or over-compensate for the impact of market factors such as liquidity constraints, slippage, spread, and order execution delays;
Hindsight bias. Simulation models are constructed with the benefit of historical knowledge. No representation is made that any live account will or is likely to achieve profit or loss figures similar to those reflected in simulated results;
Historical performance does not guarantee future results. Market conditions change. A configuration that performed well in a historical simulation window may perform differently in future market conditions;
Quarterly updates are not a guarantee of continued consistency. Updates to Configuration Examples reflect new simulation runs over updated data windows — they do not guarantee that any configuration will remain profitable or consistent going forward;
No representation of suitability. Configuration Examples are published as reference starting points for your own analysis. They are not investment recommendations, trading signals, or entry/exit instructions. You are solely responsible for any trading decisions you make and their outcomes.

6. Eligibility

To use the Service you must:

Be at least 18 years of age;
Have a valid TradingView account (free or paid);
Not be accessing the Service from a jurisdiction where the receipt of such services is prohibited by law;
Have sufficient knowledge and experience in financial markets to understand that technical analysis tools do not guarantee trading outcomes.

By subscribing, you represent and warrant that you meet all eligibility requirements above.

7. Subscription & Automatic Renewal

Subscriptions are billed on a monthly recurring basis. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date.

Renewal price: Your subscription renews at the then-current price displayed on the pricing page. The Operator reserves the right to change subscription pricing with at least 30 days' prior written notice sent to your registered email address.

Subscriber limit: Access to the Service may be subject to a maximum number of active subscribers at any time, as indicated on the pricing page. The Operator reserves the right to pause new subscriptions when this limit is reached and to reopen access at a different price point when capacity allows.

Cancellation: You may cancel your subscription at any time through your Whop account management portal or by contacting us as described in Section 20. Cancellation takes effect at the end of the current billing period. You retain access to the Service until that date. Cancellation does not automatically entitle you to a refund for the current period unless the refund conditions in Section 8 are met.

Effect of cancellation: Upon cancellation, your TradingView access to the Algetris indicator is revoked at the end of the billing period. Configuration Examples are not retained after cancellation — they are delivered as TradingView presets linked to your active subscription.

8. Refund Policy

The Operator offers a 14-day no-questions-asked refund on the first-ever payment on an account, once per account (email address). To request a refund, contact us as described in Section 20 within 14 calendar days of your initial payment date. Refunds are processed through Whop and typically appear within 5–10 business days.

Refunds are not available for:

Renewal payments — only the first-ever payment on an account is eligible;
Resubscription payments — if you cancel and resubscribe, the new first payment is treated as a renewal for refund purposes;
Requests made after the 14-day window from the initial payment date;
Accounts suspended or terminated due to violation of these Terms;
Partial months of service used — no pro-rata credits are issued for unused days within a billing period, except under force majeure as described in Section 15;
Users who have initiated a chargeback, payment dispute, or claim through their bank, card issuer, or PayPal — filing a chargeback automatically disqualifies the account from any refund and may result in permanent account suspension.

EU/EEA Right of Withdrawal — Important Notice.

(a) Consent to immediate performance. By completing the purchase and ticking the corresponding consent checkbox at checkout, you expressly request that the Operator begin performing the contract — delivering access to the Algetris indicator — immediately, before the expiry of the 14-day statutory withdrawal period provided under Directive 2011/83/EU (implemented in Poland as Ustawa o prawach konsumenta).

(b) Acknowledgment of waiver. You separately acknowledge and confirm that, once delivery of the digital content has commenced with your consent, you lose the statutory right of withdrawal pursuant to Article 16(m) of Directive 2011/83/EU. You will be prompted to confirm both consents expressly at checkout before payment is processed.

The Operator's voluntary 14-day refund described above operates independently of and in addition to your statutory rights. Nothing in these Terms affects any mandatory consumer rights you hold under Polish or EU law that cannot be waived by contract.

9. Intellectual Property

All intellectual property rights in and to the Algetris indicator — including but not limited to the source code, algorithms, structural sequence logic, proprietary entry and confirmation engine, session framework architecture, Day Bias Filter logic, MAE/MFE engine, visual design, calibration methodology, Configuration Examples, and all associated documentation — are and remain the exclusive property of the Operator.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to use the Algetris indicator solely for your own personal trading analysis within TradingView. This licence does not permit:

Copying, reproducing, or reverse-engineering any part of the indicator's code or logic;
Sharing, distributing, sublicensing, or reselling access to the indicator or Configuration Examples;
Publishing screenshots, parameters, or derived data from Configuration Examples for commercial purposes;
Attempting to reconstruct or replicate the proprietary entry and confirmation engine, session logic, or any other part of the indicator's internal logic;
Using the indicator or its outputs to develop competing products or services;
Granting any third party access to your subscription credentials or TradingView access linked to your subscription;
Recording, capturing, streaming, or broadcasting the indicator's visual output — including screen recordings, livestreams, and video content on any platform (YouTube, Twitch, or similar) — in any manner that reveals, demonstrates, or could enable reconstruction of the indicator's proprietary structural logic, session framework, or entry and confirmation methodology;
Using automated tools, bots, scripts, or any programmatic means to extract, collect, copy, or redistribute the indicator's outputs — including displayed levels (Entry, SL, TP1, TP2, TP3), structural reference levels, or analytical data — for any purpose other than your own personal trading analysis.

Any breach of these intellectual property provisions constitutes grounds for immediate termination of access without refund and may result in legal action.

10. Acceptable Use

You agree not to use the Service:

For any unlawful purpose or in violation of any applicable law or regulation;
To attempt to gain unauthorised access to TradingView's systems or the indicator's protected code;
In any manner that could harm, disable, or impair the Service or interfere with other users' access;
To create derivative works, automated systems, or trading bots based on the indicator's outputs without the Operator's prior written consent;
To submit false or misleading information in connection with any refund request, support enquiry, or account registration;
To imitate, replicate, or represent the Algetris indicator or its outputs as your own work or as a competing product.

11. Data Accuracy & Platform Dependency

The Algetris indicator relies on price data sourced through the TradingView platform. The Operator does not guarantee the accuracy, completeness, or timeliness of data provided by TradingView or any underlying exchange feed. Data presented within the indicator is provided "as is" and should be independently verified before any trading decision is made.

Outputs produced by the indicator — including structural reference levels, statistical summaries, and Observation Log entries — may differ from results observed on other charting platforms or data providers due to differences in data vendors, time-stamping, rounding, or calculation methodology. The Operator accepts no liability for such discrepancies.

12. No Financial Advice — Limitation of Liability

The Algetris indicator and all associated Configuration Examples, historical simulation results, and analytical outputs are provided strictly for informational and educational purposes. Nothing in the Service constitutes investment advice, financial advice, trading recommendations, or an offer to buy or sell any financial instrument. The Operator is not registered as an investment adviser, broker, financial analyst, or any other regulated financial entity in Poland, the European Union, or any other jurisdiction.

You should not rely on the indicator, its outputs, or Configuration Examples as the sole basis for any investment decision or transaction. If you choose to use the Service in connection with trading decisions, you do so entirely at your own risk and remain solely responsible for all trading decisions, positions, and their outcomes.

We recommend that you seek independent financial advice from a qualified financial professional before making any investment decisions. The Operator does not have access to your trading accounts or brokerage statements.

Liability cap: To the maximum extent permitted by applicable law, the Operator's total aggregate liability to you for any claims arising from or related to the Service shall not exceed the total subscription fees paid by you in the three (3) calendar months preceding the claim.

Exclusion of consequential loss: To the maximum extent permitted by applicable law, in no event shall the Operator be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, trading losses, loss of data, or business interruption, arising out of or in connection with your use of or inability to use the Service, even if the Operator has been advised of the possibility of such damages.

Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded under Polish or EU law.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Operator from and against any claims, damages, liabilities, losses, costs, and reasonable legal fees arising out of or relating to:

Your use of or access to the Service;
Any trading or investment decisions you make in connection with or in reliance on the Service, its outputs, or Configuration Examples;
Your violation of these Terms;
Your violation of any applicable law or the rights of any third party, including intellectual property rights;
Any content or data you submit, post, or transmit through the Service.

Nothing in this section limits or excludes any rights you have as a consumer under mandatory applicable law, including consumer protection provisions of Polish law or EU law that cannot be excluded by contract.

The Operator reserves the right, at its own expense, to assume exclusive control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully in asserting any available defences.

14. TradingView Disclosure

The Algetris indicator is built on and delivered through the TradingView platform. TradingView® is a registered trademark of TradingView, Inc. TradingView has no affiliation with, and does not endorse or support, the Algetris indicator or the Operator. The Operator is an independent third-party developer.

The availability of the Algetris indicator is dependent on TradingView's platform and policies. The Operator is not liable for any interruption of service caused by TradingView platform changes, downtime, policy modifications, or any other action by TradingView, Inc. over which the Operator has no control.

15. Force Majeure

The Operator shall not be liable for any delay or failure to perform its obligations under these Terms to the extent that such delay or failure results from events, circumstances, or causes beyond its reasonable control. Such events include, without limitation: acts of God, natural disasters, war, civil unrest, government action, strikes or labour disputes, internet or infrastructure outages, TradingView platform disruptions, cyberattacks, or any other force majeure event.

In the event of a force majeure situation materially affecting the Service for more than 30 consecutive days, you may cancel your subscription and receive a pro-rata refund for the unused portion of any prepaid subscription period.

16. Modifications to the Service & Terms

The Operator reserves the right to modify, update, or discontinue any aspect of the Service at any time. Material changes to these Terms will be communicated by email to your registered address at least 14 days before taking effect. Your continued use of the Service after the effective date of any change constitutes acceptance of the updated Terms.

If you do not agree to any updated Terms, you must cancel your subscription before the effective date of the changes.

17. Termination

The Operator may terminate or suspend your access to the Service immediately and without prior notice if:

you breach any provision of these Terms, including intellectual property or acceptable use provisions; or
there are reasonable grounds to believe that your continued access poses a material risk to platform security, the integrity of the Service, or other users.

Upon termination for cause, no refund will be issued. Where termination is not attributable to a breach by you, any unused prepaid subscription period will be refunded on a pro-rata basis.

You may terminate your subscription at any time as described in Section 7. Upon any termination, all licences granted to you under these Terms shall immediately cease.

18. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Poland and applicable European Union law, without regard to conflict of law principles.

Any dispute arising from or in connection with these Terms shall be submitted first to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the competent courts of the Republic of Poland.

If you are a consumer resident in the European Union, you may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Consumer rights under mandatory provisions of the law of your country of residence are not affected by the choice of Polish law.

19. General Provisions

Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, Risk Disclaimer, and Refund Policy, constitute the entire agreement between you and the Operator regarding the Service and supersede all prior or contemporaneous understandings, communications, and agreements, whether written or oral, relating to the subject matter hereof.

No Waiver

The Operator's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by the Operator.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Assignment

You may not assign or transfer your rights or obligations under these Terms without the Operator's prior written consent. The Operator may freely assign its rights and obligations under these Terms.

Notices

All notices to you shall be sent to your registered email address. Notices to the Operator shall be sent to contact@algetris.com . Notices shall be deemed received on the day sent by email, provided no delivery failure notification is received.
